One of the most important stages before purchasing a property is the title check conducted by the lawyer, in order to ascertain that the seller is indeed the sole owner of the property in question, and to ensure that there are no legal burdens on the property (e.g., liens, mortgages, or even seizures).

Unfortunately, there are many cases where it is discovered during the check that the property is burdened with mortgages or even seizures, without these being reflected in the property’s land registry sheet. Whether this is due to fraud or negligence on the part of the seller, the buyer must be informed in order to avoid unpleasant surprises in the future.

The problems and risks we mentioned earlier will be resolved by the National Cadastre when it operates fully and any third-party rights on the property, which are not recorded in the public books, become time-barred. However, this moment is in the distant future, after about two decades.

Attention: The declaration of a property in the Cadastre, even its appearance in a land registry record, does not constitute proof that there are no third-party rights on it. For this reason, it is important to conduct a title check by a lawyer before any sale. The check should be done twice. The first time the check is thorough and detailed and is conducted before the client pays a deposit or otherwise commits to the seller. The second time, the check is done briefly for any subsequent fraudulent registrations that may have occurred at the last moment before the signing of the contract.
